1. Who we are
The ATMA online shop, available at shop.bhaktimarga.ro (the “Shop”), is owned and administrated by Telstra SRL, CUI (tax ID) RO 17156323, Trade Register no. J32/87/2005, registered office at Str. 24 Ianuarie 1859, Nr. 12, postal code 557260, Șelimbăr, Romania (the “Seller”, “we”). The Shop operates the ATMA brand in collaboration with and for Bhakti Marga Romania. You can reach us at contact@bhaktimarga.ro or, for questions about orders, at hello@bhaktimarga.ro.
By placing an order in the Shop, you accept these Terms and Conditions. Please read them before ordering.
2. Definitions
- Buyer — the natural or legal person placing an order in the Shop.
- Consumer — a natural person acting for purposes outside their trade or profession.
- Products — the goods offered for sale in the Shop: sacred-art clothing, books, art objects and, occasionally, tickets to events or courses.
- Order — the purchase request submitted by the Buyer through the Shop.
3. Ordering process and conclusion of the contract
The order you place constitutes an offer to purchase. The sales contract is concluded when we send you the order confirmation email. We reserve the right to refuse or cancel an order in justified cases (for example out-of-stock items, an obvious pricing error, or suspected fraud); in such cases we will inform you and fully refund any amount already paid.
4. Prices
All prices in the Shop are expressed in Romanian lei (RON) and include VAT. Delivery costs are not included in the product prices and are shown separately at checkout, before payment. We make every effort to ensure the information and prices displayed are correct; in the event of obvious display errors, we reserve the right to correct the error and inform you before fulfilling the order.
5. Payment
Payment is made online, by card, through the payment processor Stripe. Card details are entered directly into Stripe’s secure form; we never see or store your card number. We issue a fiscal invoice for every order, which you receive by email.
6. Delivery
We deliver within Romania and the European Union through the Woot shipping platform (woot.ro), a shipping integrator working with multiple courier companies (for example DPD, Cargus, Sameday); the courier performing the delivery receives your name, delivery address and phone/email as needed for the delivery. Delivery costs are shown at checkout, depending on the destination. The delivery times we communicate are indicative; we do our best to ship as quickly as possible and inform you by email when your parcel has been handed to the courier. Please check the parcel on receipt and report any visible damage to us immediately.
7. Right of withdrawal (14 days)
In accordance with Romanian Government Emergency Ordinance no. 34/2014 on consumer rights in distance contracts, you have the right to withdraw from the contract within 14 calendar days of receiving the products, without having to justify your decision. 8. Conformity and legal guarantee
All products are covered by the legal guarantee of conformity provided by Romanian Government Emergency Ordinance no. 140/2021 on certain aspects concerning contracts for the sale of goods. If a product shows a lack of conformity, you are entitled, under the conditions of the law, to have it repaired or replaced or, where applicable, to a price reduction or a refund. 9. Event and course tickets
If you purchase tickets through the Shop for physical events or courses scheduled for a specific calendar date, free cancellation is not possible: the full price remains due even if you decide not to attend. However, please do contact us at contact@bhaktimarga.ro — we will be happy to find a solution together with you. Once a course has started, no refund of the course fee is possible.
10. Intellectual property
The Shop is operated by Telstra SRL. The ATMA brand and the sacred artworks reproduced on the products are the property of their respective rights holders (Bhakti Marga Romania / the artist) and are used by Telstra SRL with their consent. All other Shop content (texts, product photos, site layout) belongs to Telstra SRL or is used under licence. Purchasing a product does not transfer any intellectual property rights. Reproducing, distributing or commercially using these works and content without written consent is prohibited.
11. Limitation of liability
We make reasonable efforts to keep the Shop working correctly and the information displayed accurate, but we cannot guarantee uninterrupted or error-free operation of the site. We are not liable for delays or failures caused by events beyond our reasonable control (force majeure). Nothing in these terms limits the rights the law grants to consumers, nor our liability in cases where it cannot legally be limited.
12. Personal data protection
The processing of your personal data is described in our Privacy Policy, in accordance with Regulation (EU) 2016/679 (GDPR).
13. Governing law and dispute resolution
These Terms and Conditions are governed by Romanian law. Any dispute will be resolved amicably or, if that is not possible, by the competent courts of Romania.
As a consumer, you may also contact the Romanian National Authority for Consumer Protection (ANPC) — anpc.ro — or use the European online dispute resolution (ODR) platform: ec.europa.eu/consumers/odr.
